Terms of Service

Welcome to PetSociety. By using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using PetSociety, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Eligibility

You must be at least 13 years old to use PetSociety. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes. You may not:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, or lend the App to third parties
• Use the App for any commercial purpose without our consent
• Remove any proprietary notices or labels

4. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and up-to-date information
• Notifying us immediately of any unauthorized use

We reserve the right to disable any account if we believe you have violated these Terms.

5. User Content

You retain ownership of content you create and post ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, display, reproduce, modify, and distribute your content within the App for the purpose of operating and improving the service.

You represent and warrant that:

• You own or have the rights to post your User Content
• Your User Content does not violate any third-party rights
• Your User Content complies with applicable laws

We may remove any User Content that violates these Terms or that we find objectionable, without prior notice.

6. Copyright and DMCA

We respect intellectual property rights. If you believe content on our App infringes your copyright, please send a notice to support@thepetsociety.app with:

• A description of the copyrighted work
• The location of the infringing material in our App
• Your contact information
• A statement that you have a good faith belief the use is unauthorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

7. Intellectual Property

The App, including its design, logos, graphics, software, and all related intellectual property, is owned by PetSociety and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or branding without our prior written permission.

8. Prohibited Conduct

You agree not to:

• Harass, bully, threaten, or harm other users
• Post false, misleading, defamatory, or offensive content
• Impersonate any person or entity
• Spam or send unsolicited messages
• Upload viruses, malware, or malicious code
• Attempt to hack, disrupt, or gain unauthorized access to our systems
• Collect user data without consent
• Use automated means to access the App without permission
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others

9. Termination

We may suspend or terminate your account at any time, with or without cause or notice, if you violate these Terms or for any other reason at our sole discretion. You may delete your account at any time through the App settings.

Upon termination:

• Your license to use the App ends immediately
• We may delete your account and User Content
• Provisions that by their nature should survive will remain in effect

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The App will be uninterrupted, error-free, or secure
• Defects will be corrected
• The App is free of viruses or harmful components
• Content posted by users is accurate or reliable

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETSOCIETY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• Your use of or inability to use the App
• Any conduct or content of third parties
• Unauthorized access to your account
• Any other matter related to the App

Our total liability shall not exceed the greater of: (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless PetSociety and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration rather than in court, except for claims that may be brought in small claims court.

Class Action Waiver: You agree to resolve disputes on an individual basis only, and waive any right to participate in class action lawsuits or class-wide arbitration.

Informal Resolution: Before filing a claim, you agree to contact us at support@thepetsociety.app and attempt to resolve the dispute informally for at least 30 days.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts located in Ohio.

15. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, government actions, or failures of third-party services.

16. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

18. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us to be effective.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PetSociety regarding the App and supersede all prior agreements, understandings, and communications.

20. Changes to Terms

We may modify these Terms at any time by posting the updated version on our website and in the App. Material changes will be notified through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.
